1. Overview
Clean Take (operated by ASTROLABE CAE, SIREN 851 726 588) respects the intellectual property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and the equivalent EU framework (Directive 2019/790).
This policy describes how to submit a notice of copyright infringement, how we handle such notices, and the consequences for users who repeatedly infringe copyright.
2. How to file a copyright complaint
To submit a notice of alleged copyright infringement, send an email to copyright@cleantake.app containing all of the following:
- Your contact information: full legal name, mailing address, telephone number, and email address.
- Identification of the copyrighted work you claim has been infringed (title, registration number if any, link to original work).
- Identification of the allegedly infringing material, with sufficient detail to permit us to locate it (direct link to the take / session / comment on Clean Take).
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature.
Incomplete notices may not be processed.
3. Our process
- Acknowledgement: within 48 hours of receipt.
- Review: we assess whether the notice is complete and legally sufficient.
- Action: if valid, we remove or disable access to the allegedly infringing material within 7 days and notify the user who posted it.
- Counter-notice: the affected user may submit a counter-notice (see Section 4).
- Record-keeping: we retain a record of valid notices and our responses.
4. Counter-notice
If you believe your content was removed in error, you may submit a counter-notice to copyright@cleantake.app containing:
- Your contact information (as above) and physical or electronic signature.
- Identification of the material removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the relevant courts and that you will accept service of process from the party who filed the original notice.
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the content.
5. Repeat infringer policy
Clean Take terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Our internal threshold (subject to change): three (3) substantiated copyright complaints within a 12-month period results in permanent account suspension.
6. DMCA agent
For the purposes of the DMCA, our designated agent for receiving notifications of alleged copyright infringement is:
ASTROLABE CAE — Clean Take Copyright Agent 8 place du Colombier, 35000 Rennes, France Email: copyright@cleantake.app
7. Misuse
Knowingly submitting a false copyright notice or counter-notice may subject you to liability for damages under applicable law (e.g. DMCA § 512(f)). Please consider these consequences before filing.
8. Covers, samples and user-generated music
Clean Take is used by musicians who may upload cover versions, samples, and original compositions. Users are solely responsible for ensuring they have the necessary rights or licenses for any third-party music they upload. We disclaim liability for user-generated content but will act on properly submitted notices as described above.
